This means that the first time a dog bites someone, the owner might not be automatically liable for damages, but if the dog has previously shown aggressive behavior or bitten someone before, the owner could be held liable for future incidents.
However, the state of Georgia does recognize the “negligence” approach. Under this approach, a dog owner can be held liable for damages resulting from a dog bite if the owner failed to exercise reasonable care in controlling or restraining the dog.
This means that if a dog owner acted negligently in handling the dog and as a result, the dog caused harm to another person, the owner could be held responsible for the damages,” explained Marietta Injury Attorney Ramiro Rodriguez, Jr.
Georgia law also allows for a cause of action against a dog owner if they knew or should have known that their dog had a propensity to be dangerous or aggressive, even if the dog had not previously bitten anyone.
