Yes, our personal injury lawyers often handle dog bite cases.
When a dog causes injury to a person, the owner of the dog may be held liable for the damages resulting from the bite or attack. Personal injury lawyers can assist the victim in seeking compensation for medical expenses, pain and suffering, lost wages, and other related damages.
Regarding dangerous dog breeds, it’s important to note that the concept of “dangerous dog breeds” can vary depending on local laws and regulations. Some jurisdictions may have specific restrictions or regulations concerning certain breeds or types of dogs that are considered to have a higher potential for aggression. However, it is essential to understand that the behavior of a dog depends not only on its breed but also on its individual training, socialization, and environment.
Dangerous Dog Breeds in the State of Georgia
As of my last update in September 2021, in the state of Georgia, the law regarding dog bites and dangerous dogs follows a “one-bite rule” and a “negligence” approach.
The “one-bite rule” means that a dog owner may not be held strictly liable for a dog bite unless the owner was aware of the dog’s propensity to bite or attack. This means that the first time a dog bites someone, the owner might not be automatically liable for damages, but if the dog has previously shown aggressive behavior or bitten someone before, the owner could be held liable for future incidents.
However, the state of Georgia does recognize the “negligence” approach. Under this approach, a dog owner can be held liable for damages resulting from a dog bite if the owner failed to exercise reasonable care in controlling or restraining the dog.
This means that if a dog owner acted negligently in handling the dog and as a result, the dog caused harm to another person, the owner could be held responsible for the damages,” explained Marietta Injury Attorney Ramiro Rodriguez, Jr.
Georgia law also allows for a cause of action against a dog owner if they knew or should have known that their dog had a propensity to be dangerous or aggressive, even if the dog had not previously bitten anyone.
